PhotoToGo Terms of Use

By downloading or using PhotoToGo (“the App”) you agree to this End User License Agreement (“Agreement”). This Agreement is between you and APRIL’S CHOICE LLC, doing business as Pulse and Purpose (“we,” “us,” or “our”) only, not with Apple. We are solely responsible for the App and its content.

1. License

We grant you a personal, non-transferable, non-exclusive, revocable license to use PhotoToGo on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, redistribute, rent, sell, or sublicense the App except as allowed by applicable law.

2. What the App does

PhotoToGo helps you review and tidy your photo library with quick swipes. It acts on your photos through Apple’s PhotoKit: deletions are moved to the iOS Recently Deleted album (recoverable for 30 days) and favorites are mirrored as Apple Favorites. You are responsible for your own photo library. Always keep your own backups; we are not responsible for any photo loss.

3. Subscriptions

PhotoToGo offers an optional auto-renewable subscription, PhotoToGo Unlimited, which removes the daily free limit.

• Price: US $1.99 per month (or the equivalent shown in your local currency on the App Store).
• Billing: Payment is charged to your Apple Account at confirmation of purchase.
• Auto-renewal: The subscription renews automatically for the same period unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Managing & cancelling: You can manage or cancel anytime in iOS Settings → Apple Account → Subscriptions. Cancelling stops future renewals; the current paid period continues until it ends.
• Free tier: Without a subscription, the App remains usable with a daily limit on swipe decisions.

All purchases are processed by Apple and are subject to Apple’s terms; refunds, where applicable, are handled by Apple.

4. Acceptable use

Use the App only with photos you have the right to manage. Do not use the App for any unlawful purpose.

5. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

6. Limitation of liability

To the maximum extent permitted by law, APRIL’S CHOICE LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data (including photos), arising from your use of the App.

7. Apple

This Agreement is between you and APRIL’S CHOICE LLC only. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation for the App. Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you. You represent that you are not located in a U.S.-embargoed country or on any U.S. restricted-parties list, and you will comply with applicable third-party terms when using the App.

8. Changes

We may update this Agreement; the current version will always be posted at this URL, and material changes will be reflected in an app update.

9. Governing law

This Agreement is governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules, except where local consumer-protection law requires otherwise. Subject to applicable law, the state and federal courts located in King County, Washington will have jurisdiction over any dispute arising out of or relating to this Agreement.
